1. Acceptance of Terms

By accessing websites and web applications provided by RYSR, Inc. (“RYSR”), including without limitation the websites located at RYSR.org (the “Site”), you agree to be bound by the terms and conditions stated below (the “Terms”) and all applicable laws. Moreover, you accept, without limitation or qualification, these Terms and acknowledge that these Terms are the only agreement between you and RYSR, Inc. that applies to your use of the Site. RYSR reserves the right to modify the Terms or its policies relating to the Site at any time, with or without notice to you. You are responsible for regularly reviewing the Terms before accessing or using the Site. Each time you use the Site, you agree to the terms of use in force at the time you access the Site. RYSR has the right, but not the obligation, to monitor any content or use of the Site.

2. User Feedback and Ownership

Any and all comments, suggestions, ideas, or feedback (“Feedback”) concerning the Site and services rendered through the Site provided by you to RYSR shall become the property of RYSR, and RYSR shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and circulation thereof for any purpose, without acknowledgment or compensation to you. You hereby agree that such Feedback is provided on a non-proprietary and non-confidential basis. To the extent that you have any rights in the Feedback, by operation of law or otherwise, you hereby agree to assign and hereby do assign to RYSR all rights, title and interest in and to the Feedback. You agree to perform all acts reasonably requested by RYSR to perfect and enforce such rights.

3. Intellectual Property and Limited License

Unless expressly stated to the contrary, everything you see, hear, read, or access in any way on the Site is and shall remain RYSR’s copyrighted intellectual property. RYSR grants you a personal, revocable (at any time and for any reason in the discretion of RYSR), non-exclusive, non-transferable, limited license (without the right to sublicense) to display the material contained on the Site solely on your personal computer, mobile device, tablet, e-reader, smart TV, or other internet-enabled device for your personal, non-commercial use.

4. Use Restrictions

Your authorized use of RYSR materials, including the text, images, audio, video, blog posts, comments, forums, and any other content created with extant or future tools (the “materials”), means that:

  1. The materials must not be modified in any way.
  2. The materials must not be used in a way that indicates or implies a representative association of any kind between you and RYSR.
  3. Your use of the materials must abide by these Terms, and express statements regarding use of the materials in the text of the Site.

Any other use requires express written authorization and permission from RYSR. RYSR neither warrants nor represents that your use of materials displayed on the Site will not infringe the rights of third parties not owned by or affiliated with RYSR or infringe the laws of any jurisdiction outside the United States of America.

5. Accuracy and Disclaimer

To the best of its ability, RYSR includes accurate and up-to-date information on the Site without making warranties or representations as to its accuracy. RYSR assumes no liability to you or to any third party for any errors or omissions in any content that may be made available to you through the Site.

6. Assumption of Risk and Limitation of Liability

You assume all risks associated with your access and use of the Site, including any damage to your computer (or any other device used by you to access or use the Site) or related systems, and are solely responsible for the full cost of any necessary servicing, repairs, or corrections resulting from such use. You assume all risks of viewing, using, distributing, or endorsing the Site content, including third-party content.

You further assume sole responsibility to take all actions for the security and maintenance of your device systems, software, and data, including but not limited to:

  • Creating firewalls and taking similar protective measures to prevent unauthorized access.
  • Creating, storing, and updating any necessary back-up or archival copies of data.
  • Fully documenting all account information.

You agree that even if an exception were to permit the recovery of such damages, your total recovery shall not exceed the amount you paid to RYSR, if any, for access to the Site.

Everything on the Site is provided to you “AS IS” without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Neither RYSR nor any other party involved in creating, producing, or delivering the Site is liable for any direct, incidental, consequential, indirect, special, or punitive damages arising out of your access to, or use of, the Site. YOU HEREBY WAIVE, RELEASE AND DISCHARGE RYSR AND ITS PROTECTED PARTIES FROM ALL LIABILITY.

7. Image Use and Copyright Restrictions

Images displayed on the Site are either the property of RYSR or used with permission. Your use of these images, or use by anyone else authorized by you, is prohibited unless specifically permitted by these Terms, or unless a specific permission is provided elsewhere on the Site.

8. Trademarks

The trademarks, logos, service marks and product and service names related to RYSR (collectively the “Trademarks”) displayed on the Site may contain registered and unregistered Trademarks of RYSR and others. Nothing contained on the Site should be construed as granting any license or right to use any Trademark without written permission.

9. Third-Party Links and Off-Site Content

RYSR may not have reviewed all the sites linked to the Site and is neither responsible nor liable for the content of any off-site pages or other sites linked to the Site. Your use of any link is entirely at your own risk.

10. User-Generated Content and Conduct

You may not use the Site to post, transmit, or upload any unlawful, threatening, defamatory, obscene, scandalous, inflammatory, pornographic, discriminatory, harmful to minors, or profane material. RYSR reserves the right to disclose your identity to any third party claiming that content posted or uploaded by you constitutes a violation of their rights.

11. Export Compliance and Software Restrictions

Software and content from the Site are subject to United States Export Controls. You must comply with all applicable technology control or export laws and regulations.

12. Anonymous Site Data Collection

RYSR collects and stores anonymous information each time you visit the Site. This data may include the date and time of your visit, IP address, host, browser type, and referring URL. This data is used solely for statistical analysis.

13. Account Security and User Responsibilities

You are responsible for maintaining the confidentiality of your password and account, and fully responsible for any activity that occurs under your account.

14. Termination of Access and Account Removal

RYSR may, at its sole discretion and without prior notice, terminate your access to the Site and your account at any time, for any reason or no reason.

15. Disclosure of Information and Legal Compliance

You acknowledge, consent and agree that RYSR may access, preserve and disclose your account information and content if required to do so by law or in good faith belief that such access is necessary.

16. No Waiver of Terms

The failure of RYSR to exercise or enforce any provision of these Terms shall not be deemed a waiver.

17. Indemnification

YOU AGREE TO INDEMNIFY RYSR AND ITS PROTECTED PARTIES FROM AND AGAINST ANY DAMAGES, LIABILITIES, LOSSES, COSTS AND EXPENSES ARISING OUT OF YOUR USE OF THE SITE OR BREACH OF THESE TERMS.

18. Choice of Law

These Terms are governed by the laws of the State of Georgia, United States of America. The federal and state courts located in Atlanta, Georgia shall have exclusive jurisdiction over all actions arising out of your use of the Site.

19. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions.
